Terms and Conditions

Welcome to Sag Harbor Florist, a brand of Anastasia's Flowers Inc. ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our website located at www.sagharborflorist.net (the "Site") and any purchases, orders, or inquiries made through it. By using the Site, placing an order, or submitting an inquiry, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Sag Harbor Florist, operated by Anastasia's Flowers Inc., is a floral design and retail business located in New York. Products and services offered through the Site include floral arrangements, gifts, and related items available for purchase or custom order.

2. Orders and Payment

  • All orders placed through the Site are subject to acceptance and product availability.

  • Prices are listed in U.S. dollars and are subject to change without notice. Pricing at the time of order confirmation applies to that order.

  • Payment is processed securely through Stripe for store products, workshops, and other Squarespace-based purchases. Payment for custom floral arrangement orders is processed securely through BBrooks. We do not store your full payment card information on our own systems in either case.

  • We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity. If your order is canceled after payment, you will receive a full refund.

3. Delivery and Fulfillment

  • Delivery windows and areas are as stated at checkout or as communicated directly. We are not responsible for delays caused by weather, incorrect address information, recipient unavailability, or circumstances outside our control.

  • Substitutions: Because fresh flowers are a natural product subject to seasonal and market availability, we reserve the right to substitute flowers, containers, or design elements of equal or greater value while preserving the overall style and color scheme of the arrangement ordered.

  • It is the customer's responsibility to provide accurate delivery information. Additional fees may apply for redelivery due to incorrect address information provided by the customer.

4. Cancellations, Refunds, and Returns

Because our products are perishable and orders are often prepared and scheduled for delivery on a tight timeline, this policy is strictly enforced:

  • Cancellations: All order cancellation or modification requests must be submitted in writing (email or contact form) within 2 hours of placing your order, and only if the order has not yet entered production. Once production has begun, the order is final and non-refundable.

  • All sales are final once an order has been confirmed and production has started. We do not offer refunds or exchanges for change of mind, incorrect occasion selection, or failure to provide accurate delivery information.

  • Delivery issues: We are not responsible for non-delivery or delay caused by an incorrect or incomplete address, a recipient who is unavailable to accept delivery, or access restrictions at the delivery location (e.g., gated communities, secured buildings). No refund will be issued in these cases; redelivery may be arranged at an additional cost.

  • Damaged or incorrect orders: If your arrangement arrives visibly damaged or is materially different from what was ordered, you must notify us within 24 hours of delivery and include a photograph. Valid claims will be remedied at our discretion through replacement or store credit — refunds are not guaranteed and will only be issued at our discretion.

  • Custom and event orders: Deposits for custom or event work are non-refundable once submitted, reflecting time, sourcing, and design work already committed to your order.

5. Inquiries and Custom Orders

For custom arrangements, events, or inquiries submitted through contact forms, any quotes or estimates provided are non-binding until confirmed in writing and, where applicable, a deposit is received. Deposit and cancellation terms for custom/event work will be provided at the time of quote.

6. Intellectual Property

All content on the Site — including photographs, text, logos, and design — is owned by [Sag Harbor Florist] or its licensors and may not be copied, reproduced, or used without prior written permission.

7. User Conduct

You agree not to use the Site for any unlawful purpose, to submit false or misleading information, or to interfere with the Site's normal operation.

8. Limitation of Liability

To the fullest extent permitted by law, [Sag Harbor Florist] is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products, including delivery delays or product substitutions made in accordance with Section 3. Our total liability for any claim is limited to the amount paid for the order in question.

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of the Site after changes are posted constitutes acceptance.
